Copyright Policy

Xiam respects intellectual property rights and expects users to do the same. This policy explains how to report copyright infringement and how we respond.

1. Respecting Copyright

You may only post content on Xiam that you own, have permission to use, or are otherwise legally entitled to share (for example, under fair use/fair dealing principles, where applicable). Posting someone else's copyrighted work without authorization — including debate arguments, video clips, music, or images — may violate this policy and applicable copyright law.

Xiam recognizes that certain uses of copyrighted material may be lawful under applicable exceptions and limitations, including fair use, fair dealing, criticism, commentary, news reporting, research, education, and parody, depending on the jurisdiction and circumstances.

Examples of potentially infringing content include: uploading copyrighted movies to Discover, reposting someone else's videos without permission, uploading copyrighted music clips as your own work, or posting copyrighted images in Stories without authorization.

This policy applies to content shared through private messages as well as public surfaces of the Service. However, Xiam does not actively monitor all private communications and generally acts upon reports, automated safety signals, or legal requirements.

2. Submitting a Copyright Complaint

If you believe content on Xiam infringes your copyright, submit a complaint to xiamformilo@gmail.com including:

1. Identification of the copyrighted work you claim has been infringed
2. The specific URL or location of the allegedly infringing content on Xiam
3. Your contact information (name, email address)
4. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
5. A statement, made under penalty of perjury, that the information in your complaint is accurate and that you are the copyright owner or authorized to act on their behalf
6. Your physical or electronic signature

Incomplete complaints may delay review. In appropriate circumstances, particularly where infringement appears clear on its face or there is a significant risk of ongoing harm, Xiam may temporarily remove or restrict access to content pending receipt of additional information.

Xiam may use automated tools to detect potentially infringing material, including duplicate uploads and signals indicating unauthorized use of copyrighted content. Automated systems may assist review but do not make final legal determinations regarding ownership or infringement.

3. Our Response

Upon receiving a valid complaint, we will:

• Review the claim
• Remove or restrict access to the allegedly infringing content where appropriate
• Notify the user who posted the content
• Apply a strike to the account under our Repeat Infringer Policy (Section 5)

4. Counter-Notice

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notice to xiamformilo@gmail.com including:

1. Identification of the content that was removed and its prior location
2. A statement, under penalty of perjury, that you have a good-faith belief the content was removed as a result of mistake or misidentification
3. Your name, address, and phone number
4. A statement consenting to the jurisdiction of the applicable courts and that you will accept service of process from the complaining party

We may restore the content if the original complainant does not pursue further legal action within a reasonable period after receiving your counter-notice, unless we are otherwise required to keep it down.

5. Repeat Infringer Policy

Accounts that receive multiple valid copyright complaints will face escalating enforcement, up to and including permanent account termination. We track copyright strikes per account. Xiam may consider factors including the number of valid complaints, seriousness of infringement, timing of complaints, and whether the user repeatedly uploads infringing material after warnings.

Xiam may preserve copies of removed content, account identifiers, timestamps, and complaint records as reasonably necessary to investigate disputes, comply with legal obligations, and defend legal claims.

6. Trademark Complaints

If you believe your trademark is being infringed or misused on Xiam (for example, in a username, profile, or impersonation context), contact us at xiamformilo@gmail.com with details of your trademark registration (if any) and the infringing use.

7. False or Abusive Claims

Submitting a knowingly false copyright complaint may result in legal liability for the complainant and, where appropriate, action against the reporting account on Xiam. Repeated submission of knowingly false, abusive, or bad-faith copyright complaints may result in restrictions on a reporting account and, where appropriate, legal action.

8. Changes

We may update this policy as Xiam grows and applicable law evolves. Material changes will be noted in-app.
